Agreement to Terms
By accessing or using Pixel Password's visual authentication service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not access or use our Service.
Description of Service
Pixel Password provides a visual authentication system that allows users to create and use pattern-based passwords as an alternative to traditional text-based passwords. Our Service includes web applications, mobile applications, APIs, and related services.
Account Registration
To use certain features of our Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your visual password pattern
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
Acceptable Use
You agree not to use our Service to:
- Violate any applicable laws, regulations, or third-party rights
- Attempt to gain unauthorized access to our systems or other users' accounts
- Transmit malware, viruses, or other malicious code
- Interfere with or disrupt the integrity or performance of our Service
- Reverse engineer, decompile, or attempt to extract the source code of our software
- Use automated systems or software to extract data from our Service
- Impersonate any person or entity or misrepresent your affiliation
- Use the Service for any illegal or unauthorized purpose
Intellectual Property
The Service and its original content, features, and functionality are owned by Pixel Password and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you submit through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Service.
Service Availability
We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency maintenance or security updates
- Circumstances beyond our reasonable control
We are not liable for any loss or damage resulting from Service unavailability.
Subscription and Payments
Free Tier
We offer a free tier with limited features. Free accounts may have restrictions on usage volume, available features, and support options.
Paid Subscriptions
Paid subscriptions provide access to additional features and higher usage limits. By subscribing to a paid plan, you agree to:
- Pay all applicable fees as described at the time of purchase
- Provide valid and current payment information
- Authorize us to charge your payment method on a recurring basis
Refunds
Subscription fees are non-refundable except as required by law. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period.
Enterprise Agreements
Enterprise customers may be subject to additional or different terms as specified in a separate enterprise agreement. In the event of a conflict between these Terms and an enterprise agreement, the enterprise agreement will control.
Third-Party Services
Our Service may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. You acknowledge that you use the Service at your own risk.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXEL PASSWORD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Pixel Password and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any third-party rights.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
Termination
You may terminate your account at any time by contacting us or using the account deletion feature in the Service. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
Dispute Resolution
Before initiating any legal action, you agree to first attempt to resolve any dispute informally by contacting us. If we cannot resolve the dispute within thirty (30) days, either party may proceed with legal action. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Pixel Password regarding the Service.
